Terms of Service

The terms that govern your use of ServerGurus infrastructure and services.

These Terms of Service (“Terms”) govern your use of infrastructure services provided by Soundarya Infotech Pvt Ltd (“ServerGurus”, “we”, “us”) through servergurus.com.

Services

ServerGurus provides bare metal server rentals, GPU cloud VMs, cloud VPS, private cloud setup, and managed services including 24/7 NOC monitoring, DevOps, and AWS consulting. All services are hosted at or managed from the CtrlS Tier IV datacenter in Hyderabad unless otherwise specified.

Billing & Payment

Indian customers are billed in INR with 18% GST by Soundarya Infotech Pvt Ltd (GSTIN: 36ABICS3487R1ZB). International customers may be billed in USD. Payment is due within the billing cycle specified in your service agreement. Late payments may result in service suspension after a 7-day grace period.

Service Level Agreement

We target 99.995% uptime for infrastructure hosted at the CtrlS Tier IV facility. Scheduled maintenance windows are communicated 48 hours in advance. See our SLA page for detailed terms and credit policies.

Acceptable Use

You agree to use our services in compliance with all applicable laws. See our Acceptable Use Policy for prohibited activities.

Termination

Either party may terminate services with 30 days written notice. We may suspend services immediately for AUP violations or non-payment. Upon termination, you have 14 days to retrieve your data.

Data Backup & Data Loss

You are solely responsible for maintaining independent, off-site backups of all data, applications, and configurations hosted on our infrastructure. Unless you have purchased a written, explicitly-scoped managed backup service, ServerGurus does not guarantee the retention, integrity, or recoverability of your data. To the maximum extent permitted by law, ServerGurus shall not be liable for any loss, corruption, deletion, or inaccessibility of data arising from hardware failure, storage or disk failure, software faults, power or cooling events, network incidents, migration, maintenance, accidental deletion, or any other cause. Any managed backup service is provided on a commercially reasonable-efforts basis and does not constitute a warranty against data loss.

Customer Security Responsibilities

You are responsible for securing your servers, operating systems, applications, credentials, access keys, firewall rules, and user accounts. ServerGurus is not responsible or liable for any loss, breach, unauthorized access, data exfiltration, or damage resulting from your acts or omissions, including weak or compromised passwords, unpatched or misconfigured software, exposed services, leaked credentials, insider actions, or failure to follow security best practices. Where we provide managed security or hardening services, they reduce but do not eliminate risk, and do not shift liability for a compromise to ServerGurus.

Malware, Ransomware & Cyberattacks

ServerGurus shall not be liable for any damage, downtime, data loss, ransom demand, or business interruption caused by malware, ransomware, viruses, distributed denial-of-service (DDoS) attacks, zero-day exploits, supply-chain compromises, or other malicious activity, whether targeting your environment or the broader network. Restoration of an affected environment is your responsibility and, where we assist, may be billed as a separate professional-services engagement. We do not pay, negotiate, or facilitate ransom demands on your behalf.

Force Majeure

ServerGurus is not liable for any failure or delay in performance caused by events beyond our reasonable control, including natural disasters, fire, flood, earthquake, pandemic, war, terrorism, civil unrest, labor disputes, utility or upstream-carrier failures, government action, or third-party datacenter, hardware-vendor, or cloud-provider outages.

Limitation of Liability

To the maximum extent permitted by law, our total aggregate liability for any claim arising out of or relating to the services is limited to the fees you paid for the specific affected service in the three (3) months preceding the event giving rise to the claim. ServerGurus shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, or for any loss of data, profits, revenue, goodwill, or business, even if advised of the possibility of such damages. Services are provided on an “as is” and “as available” basis without warranties of any kind except as expressly stated in a signed agreement.

Indemnification

You agree to indemnify and hold harmless ServerGurus, Soundarya Infotech Pvt Ltd, and its officers and employees from any claims, damages, liabilities, or costs (including legal fees) arising from your use of the services, your content or data, your security practices, or your violation of these Terms or applicable law.

Governing Law

These Terms are governed by the laws of India. Disputes shall be subject to the jurisdiction of courts in Hyderabad, Telangana.
